Critical Notice
By participating in any activity organized by Abu Buggy Adventure Rental LLC, you are entering into a binding legal agreement. This document affects your legal rights under the laws of the United Arab Emirates. Please read every section carefully.
1. Nature of Activities & Inherent Risks
Off-road driving, dune buggy tours, and quad biking are classified as high-risk adventure sports. By booking and participating, you explicitly acknowledge and assume the inherent risks involved, which include but are not limited to:
- Vehicle Instability: Sudden rollovers, tipping, or loss of control due to soft sand, steep dunes, or hidden obstacles.
- Environmental Factors: Extreme heat, sudden sandstorms, glare, and uneven terrain.
- Physical Strain: Violent jolts, sudden stops, and vibrations that can affect the spine, neck, and back.
- Interaction with Wildlife: Unpredictable behavior of camels or falcons during trekking or shows.
Voluntary Assumption of Risk: In accordance with Article 296 of the UAE Civil Code, you acknowledge that you are voluntarily participating in these activities with full knowledge of the dangers involved. You agree that Abu Buggy Adventure Rental LLC is not liable for injuries resulting from the inherent nature of the sport, provided safety protocols are followed.
2. Mandatory Safety Protocols
Strict adherence to the following rules is a condition of your contract. Violation will result in immediate termination of the tour without refund:
A. Protective Gear
Drivers and passengers must wear Department of Transport (DOT) or equivalent approved helmets and fasten seatbelts/harnesses at all times while the vehicle is in motion.
B. Convoy Discipline
This is a guided tour, not a race. You must follow the lead guide's path exactly. Overtaking other buggies, drifting, or driving side-by-side is strictly prohibited.
C. Zero Tolerance Policy
Operation of vehicles under the influence of alcohol, narcotics, or any impairment-causing medication is a criminal offense in the UAE. We reserve the right to notify Dubai Police if a participant is found intoxicated.
3. Medical Declaration
By signing the physical waiver on-site, you warrant that you do not suffer from any of the following conditions:
- Pregnancy (at any stage).
- Heart conditions or high blood pressure.
- Pre-existing back, neck, or spinal injuries.
- Recent surgeries or any condition that impairs reaction time.
4. Liability for Vehicle Damage
"You Break It, You Buy It." While our vehicles are insured for third-party liability on roads, off-road damage caused by driver negligence is the sole responsibility of the renter.
- Negligence defined as: Drifting, hitting stationary objects, rolling the vehicle due to excessive speed, or ignoring guide instructions.
- Costs: You agree to pay for all parts, labor, and recovery costs associated with repairing damage caused by your negligence. A security deposit may be required via credit card hold.
5. Release of Liability & Indemnity
To the fullest extent permitted by UAE Law (specifically Federal Law No. 5 of 1985), you hereby release, waive, discharge, and covenant not to sue Abu Buggy Adventure Rental LLC, its owners, agents, and employees from liability for any and all claims resulting in personal injury, accidents, or illnesses (including death) and property loss arising from your participation.
You further agree to indemnify and hold harmless Abu Buggy Adventure Rental LLC from any claims made by third parties (including your passengers) arising out of your operation of the vehicle.
6. Emergency Procedures
In the event of an accident:
- Stop immediately: Do not attempt to move the vehicle if it is unsafe.
- Remain calm: Wait for the lead guide to assess the situation.
- Medical Support: Our guides are trained in First Aid. For serious emergencies, we have direct lines to Dubai Ambulance Services and Air Wing rescue if required.
Acknowledgement
This digital page serves as a reference. All participants will be required to sign a physical or digital copy of this waiver upon arrival at our base camp. Refusal to sign will result in cancellation of the booking.
